Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and TradeStack.ai (“TradeStack,” “we,” “us,” or “our”) and govern your access to and use of our field-service software and our “Growth Engine” marketing services, including our website, applications, and features that publish content and run advertising on your behalf (together, the “Services”).
By creating an account, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
The Services
TradeStack provides software for home-service businesses to run scheduling, online booking, invoicing, card processing, and reporting, and to market their work. Core features are offered at no cost; paid features (including the Growth Engine) are billed as described at sign-up or in your order. We may add, change, or remove features over time.
Connected accounts and third-party platforms
Some features let you connect third-party accounts, such as a Facebook Page, Instagram professional account, Meta ad account, or Google Business Profile, so TradeStack can publish content and run advertising on your behalf. When you connect an account:
- You authorize TradeStack to access and use that account through the platform’s official APIs to provide the features you enable;
- You remain responsible for complying with the terms and policies of each connected platform (for example, the Meta Platform Terms, Meta advertising policies, and Google’s terms);
- You confirm you have the rights and permissions to the content you ask us to publish or promote; and
- You may disconnect an account at any time, after which we stop accessing that platform’s data as described in our Privacy Policy.
Third-party platforms are operated independently, and we are not responsible for their availability, decisions, or actions (including ad review, account restrictions, or content removal).
Your content and license
You retain ownership of the content and data you submit to the Services (“Your Content”), including job photos, business information, and customer data. You grant TradeStack a non-exclusive, worldwide license to host, process, reproduce, and display Your Content solely to operate and provide the Services, including publishing content you approve to your connected accounts and generating marketing on your behalf.
You are responsible for Your Content and for obtaining any consents required to use it (for example, permission to post photos of a customer’s property). You must not submit content that is unlawful, infringing, deceptive, or that violates a third party’s rights or a connected platform’s policies.
Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent, or misleading purpose;
- Publish advertising or content that violates applicable law or the policies of a connected platform;
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or related systems;
- Reverse engineer, resell, or misuse the Services except as permitted by law; or
- Send spam or contact anyone without the consents required by applicable law.
Fees and billing
Free features are provided at no charge. Paid features are billed in advance on the cycle shown at purchase and are charged through our payment processor. Unless stated otherwise or required by law, fees are non-refundable. We may change pricing on a prospective basis with reasonable notice; continued use of a paid feature after a change takes effect means you accept the new pricing. You are responsible for any taxes and for amounts you spend on advertising through connected ad accounts.
Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or as needed to comply with law. Upon termination, your right to use the Services ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and dispute terms) will survive. Data handling after termination is described in our Privacy Policy.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that marketing results, ad approvals, or business outcomes will be achieved.
Limitation of liability
To the fullest extent permitted by law, TradeStack and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amounts you paid us for the Services in the 12 months before the claim or US$100.
Indemnification
You agree to indemnify and hold harmless TradeStack and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Services, your connected accounts, or your violation of these Terms or applicable law.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Services after an update takes effect means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute not subject to arbitration or small-claims court will be the state and federal courts located in California, and you consent to their jurisdiction.
